LB1024 is unconstitutional. This law creates more bureaucracy for our schools and creates new administrative expenses for our school budgets which will raise property taxes. But worst of all, LB1024 erodes local control of our schools. Because of LB1024, our local schools are at risk of being controlled by activist federal judges. I opposed the bill while it was under consideration by the Legislature and had I been Governor, I would have vetoed it.
Dave Heineman signed into law a bill that even his own Attorney General stated is unconstitutional. LB 1024 reflects poorly on Nebraskans and the state’s commitment to equal education. Decisions of this much importance to Omaha’s future should not be left up to the courts. Governor Heineman should not be playing politics with our children’s education.
